Free Appropriate Public Education (FAPE)

FAPE is a legal term from the Individuals with Disabilities Education Act (IDEA) in the U.S. It ensures that children with disabilities, including ADHD, have the right to an education tailored to their needs at no cost to the family. FAPE aims to provide educational services that enable children to make meaningful educational progress. FAPE also plays a role in Section 504 of the Rehabilitation Act of 1973.

IDEA has specific criteria for eligibility based on certain categories of disabilities and requires that the disability affects the child’s educational performance. Under IDEA, students receive an Individualized Education Plan (IEP), which is a detailed document outlining the special education services and supports the student will receive.
